Terms of Use

These Terms of Use ("Terms") govern your use of the WSPuffer mobile application (the "App"), developed by Wyrick Studios. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

License

Subject to your compliance with these Terms, Wyrick Studios grants you a personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for personal, non-commercial purposes only. The App is licensed, not sold, to you.

Permitted use

You agree not to: (a) reverse-engineer, decompile, or disassemble the App except where allowed by law; (b) modify or create derivative works based on the App; (c) use the App in any way that violates applicable law; or (d) attempt to bypass any technical limitations of the App, including unlock mechanisms tied to in-app purchases.

In-app purchases

The App offers optional, one-time, non-consumable in-app purchases. All transactions are processed by Apple through the App Store. Apple's Terms of Sale apply to those transactions. Wyrick Studios does not process, see, or store your payment information. Refunds are handled by Apple at reportaproblem.apple.com.

No accounts, no warranty

The App does not require an account and does not collect personal information. The App is provided "as is" and "as available" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, Wyrick Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Total liability for any claim relating to the App is limited to the amount you paid for the App or affected in-app purchase, if any.

Apple's role

You acknowledge that these Terms are between you and Wyrick Studios, not Apple. Apple is not responsible for the App or its content. In the event of a conflict between these Terms and the Apple Media Services Terms and Conditions, the Apple terms govern with respect to your use of the App via Apple services. Apple and its subsidiaries are third-party beneficiaries of these Terms.

Changes

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. Material changes will be announced on this page.

Governing law

These Terms are governed by the laws of the United States and the State in which Wyrick Studios is established, without regard to its conflict-of-law principles.
